The DHS has updated their Office of Intelligence and Analysis Policy Manual 2025 by deleting ‘Gender’ and ‘Gender Identity’ from its pages concerning ‘engaging in intelligence activities.

There are five key pieces of information that must be understood as to why this change in their policy is important to the lgtbqia2+ people in the U.S. and how it can impact them.

3. Executive Order 14161 Protecting the U.S. from Foreign Terrorists and Other National Security and Public Safety Threats.

Page 495 - OCR should return its enforcement of sex discrimination to the statutory framework of Section 1557 and Title IX. Specifically, it should: 1. Remove all guidance issued under the Biden Administration concerning sexual orientation and gender identity under Section 1557, particularly the May 2021 announcement of enforcement82 and March 2022 statement threatening states that protect minors from genital mutilation.83 2. Issue a general statement of policy specifying that it will not enforce any prohibition on sexual orientation and gender identity discrimination in the Section 1557 regulation and that it will prioritize compliance with the First Amendment, RFRA, and federal conscience laws in any case implicating those claims. DOJ should commit to defending these actions aggressively against inevitable court challenges, including under cases such as Heckler v. Chaney.

Page 584 - Rescind regulations prohibiting discrimination on the basis of sexual orientation, gender identity, transgender status, and sex characteristics. The President should direct agencies to rescind regulations interpreting sex discrimination provisions as prohibiting discrimination on the basis of sexual orientation, gender identity, transgender status, sex characteristics, etc.

This is the foundational understanding that must be understood in to see why the implementation of EO 14151 and 14161 are detrimental to the lgtbqia2+ communities; specifically, to the transgender communities and individuals who utilize public means by online activity or by physical activity which will most likely amount to public protesting.

In recent weeks students like Mahmoud Khalil and Rümeysa Öztürk are just two out of dozens of other students and faculty members who with valid and legal means to be permanent residents or student visas have been detained by ICE. Some have been sent to facility in Louisiana but most if not all have been arrested without due process as is part of their legal rights as non-citizens.

We now know that Secretary of State Marco Rubio has said that “Thursday that at least 300 student visas have been revoked since President Donald Trump took office and that they’re “looking every day” for more. HuffPost These visas have been revoked in relation to campus protests, but the administration is concentrating on students with visas currently. This could very well change in the future.

The Alien Enemies act is an old action that allows the president to detain or deport natives and citizens of an enemy nation. This was written and used in 1798 when the young country was still in a state of turmoil with many non-citizens who could be deported for their actions. That was 1798.

Today in 2025 it is far more to determine who is a citizen and who isn’t. Except now, with the introduction and the possibility of the SAVE Act being passed the bill will require individuals to provide documentation to show proof of citizenship to register to vote in Federal elections or that is the initial intent of it. It carries for more detrimental facets that will require birth certificates and legal name changes as proof of citizenship which affect many people who changed their names legally when they were married.

All of these things are foundational in the changes that have been made to the policy of HHS specifically from page 79 concerning 3-102-02. General Requirements. This is the original archived copy from January 19, 2025.

The use of these characteristics is permitted only in combination with other information, and only where (1) intended and reasonably believed to support one or more of I&A’s national or departmental missions and (2) narrowly focused in support of that mission (or those missions)

Gender, Sexual Orientation and Gender Identity have been omitted from the new updates. I have conducted my own search for the manual that is supposed to be posted on the HHS website. It merely states, Page Not Found.

When all these things are put together it is quite clear that any person from the lgtbqia2+ community who speaks up may find that they no longer have first amendment rights and could be detained by ICE or by HHS. The implication of this and what could happen must only be documented but must be made public.
